The petitioner has addressed a communication on 23-7-2019 to the Metropolitan Commissioner, Mumbai Metropolitan Region Development Authority ("MMRDA"). This communication, copy of which is taken on record and marked "X" for identification, records the petitioner's no objection to handover physical possession of the subject-premises and to

suresh 19-WPL-2182.2019.doc accept the amount offered by the MMRDA as compensation, without prejudice and under protest. The petitioner will reserve its right to claim enhanced compensation than the one offered by the MMRDA. Keeping open that avenue and all contentions of the parties in that behalf, we dispose of this writ petition. 2.

Let the amount deposited in Court be paid over to the petitioner with accrued interest, subject to the above. 3.

The petitioner's Advocate states, on instructions, that possession of the subject-property will be handed over on or before 15-9-2019.
