DATED : 23RD FEBRUARY, 2015 P.C.:
The learned Assistant Government Pleader appearing for the State states that, an amount of Rs.4,63,13,720/- has been deposited in this Court on 16th February, 2015. If the amount is so deposited, it would be necessary for the Collector and the Special Land Acquisition Officer to make a reference under Section 30 of the Land Acquisition Act, 1894, to the Civil Court as per the order dated 10th October, 2013 in Writ Petition No.1651 of 2013. bsb 2 CONPW102.14.doc of the Act to the Civil Court within a period of three weeks. It is informed to this Court by the learned Assistant government Pleader that a review application for seeking the review of the order dated 10th October, 2013, is filed. If the order is reviewed and the amount lesser than the amount of Rs.4,63,13,720/- is required to be paid to the concerned land holder, the State Government is permitted to withdraw the excess amount deposited in this Court. The amount of Rs.4,63,13,720/- should be presently placed in a fixed deposit account of a nationalized bank so that the claimants would not be deprived of the interest on the same. After the review application is decided, the amount should be remitted to the reference Court.
In view of the aforesaid, we dispose of the contempt petition with no order as to costs.
