Heard Mr. Sawant, learned Counsel for the applicant at length. 2.

Mr. Sawant submitted that Dashrath Maruti Kamble had instituted Guardianship Petition No.6 of 1997 for his appointment as guardian of minor Ganesh Suresh Kamble. By order dated 03.03.1997, this Court (Coram : A. P. Shah, J. as His Lordship then was) appointed the petitioner Dashrath Maruti Kamble as guardian of the minor. He submitted that minor Ganesh Suresh Kamble was born on 03.03.1992 and has completed the age of 18 years as on 03.03.2010. He submitted that the guardian Dashrath Maruti Kamble died at Mumbai on 10.02.2011.

He submitted that by order dated 03.03.1997, this Court directed the Manager of Central Bank of India, Delisle Road Branch, Mumbai - 400 011 to forward to the Account Officer, High Court (O.S.), Mumbai all dues under S.B. Account No.18700 payable to the minor of the deceased late Smt. Kamal Suresh Kamble (mother of minor) and directed the Account Officer, High Court (O.S.) to open the account in 1/2

JO165_17.sxw the name of minor Master Ganesh Suresh Kamble and to invest the said amount in Fixed Deposit with any Nationalised Bank / Securities and hold the investment till the minor attains the age of majority. 4.

Mr. Sawant submitted that as the applicant minor has attained majority in the year 2010, he is entitled to receive amount from the Account Officer, High Court, Bombay which is lying in Cause No.11088. He has invited my attention to the certificate of balance issued by the Accounts Officer, High Court, Bombay showing therein cash balance of Rs.49,244/- and various fixed deposits with various Nationalised Banks totalling Rs.1,11,606/-. He, therefore, submitted that the Accounts Officer, High Court, Bombay may be directed to pay the amount to the applicant.

In view thereof, the Accounts Officer, High Court, Bombay is directed to pay the amount along with accrued interest, if any, to the applicant. The Judge's order is separately signed. (R. G. KETKAR, J.) Minal Parab 2/2
