The Petitioner has already filed Securitization Application before DRT which is stated to be pending. The Petitioner had also moved for interim reliefs. By orders dated 16/04/2018 and 29/06/2018, the Interim Applications of the Petitioner have been dismissed. Instead of challenging these orders before DRAT where the Petitioner would be required to pay minimum of 25% to a maximum of 50% of the outstanding dues, the Petitioner has approached this Court by filing this Writ Petition raising all sorts of legal challenges. 26. wpl 2301.18.doc filed atleast 3 Writ Petitions earlier which are dismissed/disposed of. The outstanding dues of the Petitioner mentioned in the Section 13(2) Notice dated 25/06/2011 were Rs.12.36 Crores. In the circumstances, the present Petition being an abuse of process of law, we are not inclined to entertain the Petition.

The Writ Petition is dismissed with costs quantified at Rs.25,000/- to be paid to the Respondent - Bank within 3 weeks. All legal contentions raised in the Writ Petition are kept open.
