Heard Mr. Kandade, learned Advocate for Petitioners. 2.

Present Misc. Petition is filed by the Petitioners for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of deceased Shaikh Rahimsaheb Ibrahim @ Rahim S. Ibrahim. The names of the legal heirs of the deceased are mentioned in paragraph No. 3 of the Petition. Purpose for filing the present Petition is stated in paragraph No. 7 of the Petition. I have perused the same. Heirship Certificate is sought in respect of all legal heirs. Proclamation was issued and service has been effected on all concerned parties.

In view of the above, present Misc. Petition is allowed and disposed of in terms of prayer clause (a) which reads thus:-

MPT 64-23.doc "(a) This Hon'ble Court be pleased to issue a Legal Heirship Certificate under the provisions of the Bombay Regulation Act No. VIII of 1827 declaring the legal heirs mentioned in Para No. 3 of the Petition as the only legal heirs and representatives of late Shaikh Rahimsaheb Ibrahim @ Rahim S. Ibrahim."
