This petition, filed under Sections 51(1) and 56(2) of the Juvenile Justice (Care and Protection of Children) Act, 2015 (Juvenile Justice Act), proposes adoption of a minor male child Dhrumit by the prospective adoptive parents, who have been married for over ten years without any biological or adopted children, although they are aged 52 years and 44 years, respectively. It appears that the minor they proposes to adopt is a child of an un-wed mother aged 20 years. The biological mother is a cousin sister of the 1/3

prospective adoptive mother and being an unwed, the child was surrendered. The biological mother is said to have relinquished all rights in the interest of the welfare of the child.

The prospective adoptive father is employed in a security agency. The income is on the lower side, but in the peculiar facts and circumstances of the case, given the close relationship of the parties and the willingness of the prospective adoptive parents to look after and adopt the child, I have considered this petition in that light.

The Home Study Report of the prospective adoptive parents is on record and is found to be satisfactory. The letters of recommendation and support and undertaking of the brother-in-law and sister-in-law of the prospective adoptive parents, namely, Umesh Vitthal Kondvilkar and Ujwala Umesh Kondvilkar, both aged 41 years and 38 years, respectively, is on record. They are fully aware of the proposed adoption and in the event of any unforeseen occurrence, they have undertaken to look after the minor. The medical reports of the prospective adoptive parents are also found to be acceptable and they are found suitable to adopt the child. 4.

In view of the aforesaid, I have no hesitation in allowing this petition. Accordingly, I pass the following order :- (i) Petition is allowed in terms of prayer clauses [a] and [b]. 2/3

(ii) The prospective adoptive parents shall invest a sum of Rs.1,00,000/- in the name of the child in LIC's Single Endowment Plan No.917 for 18 years. No loan shall be taken on the policy. The petitioner shall file evidence of this fact having been communicated to the LIC in the registry.

(iii) Undertakings are accepted (iv) Judge's Order is signed separately.
