Heard the learned counsel appearing for the Petitioner. The Petitioner is a member of the first Respondent Akhil Bhartiya Marathi Natya Parishad which is stated to be a Public Trust registered under the Bombay Public Trusts Act, 1950. Various illegalities and irregularities in the functioning of the first Respondent are alleged especially regarding the conduct of election.

The Petitioner who claims to be a Producer is a member of the first Respondent. Therefore, the PIL at the instance of the Petitioner cannot be entertained. However, all the remedies available to the

pil-35.14 Petitioner are expressly kept open. By keeping the remedies open, we dispose of the PIL. All contentions on merits are kept open. (P. D. NAIK, J ) (A.S. OKA, J )
