This Chamber Summons seeks deletion of petitioner no.1, who passed away on 29th September, 2012. The petitioner no.1's legal heirs are already on record, being petitioner nos. 2 and 4 in the petition. 2.

As the legal heirs of petitioner no.1 are already on record, the delay in taking out the present Chamber Summons is condoned. 3.

In the above view, the Chamber Summons is made absolute in terms of prayer clauses (a) and (b).
