By this appeal filed under section 37 of the Arbitration & Conciliation Act, 1996, the petitioner has impugned the order dated 24th July, 2017, passed by the learned arbitrator rejecting the application under section 16(2) of the Arbitration & Conciliation Act, 1996 filed by the petitioner. In my view, this appeal is not maintainable under section 37 of the Arbitration & Conciliation Act, 1996. If the petitioner is aggrieved by the final award, the petitioner can challenge the said order along with the final award under section 34 of the Arbitration & Conciliation Act, 1996. The arbitration petition is accordingly dismissed as not maintainable. (R.D. DHANUKA, J.) 1/1
