Ms.Sethna appearing for plaintiffs seeks leave to withdraw the suit on the ground that the suit has been settled out of Court. Ms.Sethna states that the defendants have paid sum of USD 242,427 of which USD 2424.27 is the Sheriff's poundage which amount will be paid by the plaintiffs/their advocates within two weeks. Ms.Sethna also states that there is no caveat pending against release of the vessel. There is also an endorsement to that effect on the praecipe for search.

Plaintiffs are at liberty to forward a copy of this order by email, fax and hand delivery. Gujarat Maritime Board (GMB) to permit beaching of the vessel. While forwarding a copy of this order by email/fax, plaintiffs will also undertake that within 48 hours they will hand over a copy of this order to GMB.
