Mr.Mahimkar appearing for defendant nos.8, 12 & 13 has no objection.

In the circumstances, the order dated 28.7.2011 is continued as order in the Notice of Motion and Notice of Motion stands disposed accordingly.

NOTICE OF MOTION NO.639 OF 2012 In view of the order passed on 16.3.2012 by this Court, Notice of Motion is not maintainable.

Mr.Nair for the plaintiff states that all the defendants except defendant nos.8, 12 & 13 for whom Mr.Mahimkar is appearing, have filed written statement. Mr.Mahimkar states that on or before 28.11.2016 written statement on behalf of defendant nos.8, 12 & 13 will be filed and copy served upon the plaintiff. Statement accepted.

Suit be listed for issues on 19.12.2016. In the meanwhile, parties to file their respective affidavit of documents, complete discovery and inspection and also file statement of admission and denial with reasons for denial.

Stand over to 19.12.2016 for issues.
