The proposed Suit is an action in damages for defamation. The Defendant resides outside Mumbai. The defamatory statement is said to have been telecast on channel which was viewed and could be viewed in Mumbai. A material part of cause of action has arisen in Mumbai. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
