Having heard this matter for sometime learned counsel for the plaintiff states that she has instructions to seek amendment to the plaint to delete claim for penalty incorporated in the suit. She seeks to withdraw the Summons for Judgment with liberty to file afresh. Accordingly, I pass the following order : (i) Summons for judgment allowed to be withdrawn. (ii) Liberty is granted to file fresh summons for judgments after the plaint is amended.

(iii) If no amendment application is not filed within 12 weeks from today list the suit for dismissal.
