Petition, therefore, allowed and accordingly disposed in terms of prayer clause - (a).
COMMERCIAL NOTICE OF MOTION NO.83 OF 2015 Mr. Kane states that in the ad-interim order dated 14th July 2015 the Court was pleased to grant relief in terms of prayer clauses - (a), (b) and (d). Mr. Kane states that now that the leave under Clause 14 has been granted, prayer clause - (c) of the notice of motion also be granted. Gauri Gaekwad

Therefore, prayer clause - (c) of the notice of motion is also granted. Notice of motion accordingly disposed in terms of prayer clauses - (a), (b), (c) and (d) as amended.
As regards defendant nos.2 and 3, Mr. Kane states that they have never been appearing though served and states that an affidavit of one Nilesh G. Sonawane affirmed on 6th September 2016 will be lodged in the registry during the course of today. Therefore, the order passed above shall cover defendant nos.2 and 3 as well.
