Heard. By this petition under Article 226 of the Constitution of India the Petitioner is challenging the order dated 06/04/2011 passed by the competent authority-1 MHADA, Mumbai in Case No.18/2010 holding that the Petitioners are unauthorised occupant of tenement No.T.N.32 of 503, gut No.159, Malwani, Mumbai and directed the Petitioner to vacate and hand over the possession to the MHADA.

The said order was challenged by the Petitioner in appeal No.3/2013. The appellate authority, by judgment dated 09/04/2013 dismissed the Petitioner's appeal. Hence, the Writ Petition.

In the meanwhile, the Petitioner applied for regularization of his occupation of the said tenement. Same was allowed and issued letter dated 21/10/2015 being No.7374/2015. A copy of the said letter is taken on record and marked "X" for identification.

In view of the subsequent development that the Authority issued letter dated 21/10/2015 regularizing the occupation of the Petitioner in the said tenement, nothing survives in the petition. 5.

Hence, the Writ Petition stands dismissed as infructuous, in view of subsequent development. JUDGE Basavraj G Patil 2/2
