By this Chamber Summons the applicants have sought two reliefs firstly transposition of the applicant / original defendant as plaintiff in place of the deceased plaintiff and secondly seeking appointment as agents of the Court Receiver in place of the deceased plaintiff in respect of certain property mentioned in prayer clause (b).

Prayer clause (a) is already been allowed vide order dated 13 th February, 2018. In the meanwhile vide order dated 11 th August, 2017 apropos prayer clause

16-cs-794-2017 (b) this Court recorded that the present arrangement between the parties in respect of the property described in prayer clause (b) to this Chamber Summons would continue till the disposal of the Chamber Summons. 3.

Today at the hearing of this Chamber Summons, learned counsel appearing for contesting defendant no. 2 and the plaintiff are agreed that the arrangement contemplated in order dated 11 th August, 2017 will continue till disposal of the suit since the suit is ripe for hearing. There will be order in terms of the above. Chamber Summons disposed of in the above terms. Suit to be listed for hearing and final disposal as per its turn.
