DATED :- FEBRUARY 3, 2016 P.C. :- 1) When these two Writ Petitions are taken up for admission, Mr. Sharma appearing for the Respondents produces a written note, duly signed, instructing him to inform the Court that through inadvertence, the notices have been despatched and demand raised on a wrong legal entity. The correct legal entity, ought to have been M/s. Franco Indian Pharmaceuticals Private Limited. Now, the Respondents will proceed against this legal entity, namely, M/s. Franco Indian Pharmaceuticals Private J.V.Salunke,PA

914(1)-WP.2809&2805.2015.doc Limited and all orders impugned in these Petitions and involving the Petitioners herein stand withdrawn. The demand pursuant to the same would not be enforced and executed.

2) Now, a fresh order on the same lines as indicated in Writ Petition No. 2804 of 2015 would be passed, on due consideration of the materials produced, including the memo of the Writ Petitions and the Annexures thereto and the affidavit in rejoinder, on or before 7th March, 2016. All the statements made by Mr. Sharma are accepted as undertakings given to this Court. 3) With the aforesaid directions, the Writ Petitions are disposed of.
