Heard learned Counsel for the parties.
The Petition challenges an order of suspension of a liquor licence in form FL III by the Collector of Mumbai, by her order dated 27 July 2016. The grievance of the Petitioner inter alia is that the impugned order is passed without as much as a show-cause notice to the Petitioner, who has held this licence since 1993. Considering the fact, however, that the Petitioner has already filed an appeal challenging the suspension of the licence under the impugned order, before the Commissioner of State Excise, Mumbai, the Petition can be conveniently disposed of in terms of the following order.

(i) The Commissioner of State Excise, Mumbai is directed to decide the Petitioner's appeal within a period of eight weeks from today;
(ii) In the meantime, pending the hearing of the appeal and for two weeks thereafter in the event the order in the appeal is against the Petitioner, the impugned order passed by the Collector of Mumbai, dated 27 July 2016 is stayed. .

The Petition is disposed of accordingly.
