The learned counsel for the defendant submits that the defendant bank has refunded the amount of bank guarantee to the plaintiff by way of a pay order. The learned counsel for the plaintiff acknowledged the receipt of the pay order.

The learned counsel for the plaintiff seeks leave to withdraw the suit.

The suit stands dismissed as withdrawn.

In view of disposal of the suit, the summons for judgment also stands disposed of.

The plaintiff is entitled refund of to court fees, if any, as per rules.
