The counsel for the applicant/petitioner states that they are yet to serve the notice upon respondent. From the record and proceedings, it appears that the notice under Order XXI, Rule 22 of the Code of Civil Procedure, 1908 was issued on 18th July 2012. In fact, by an order dated 4th March 2015, this Court was pleased to direct issuance of fresh notice upon the judgement debtor returnable on 1st April 2015. Despite that the applicant has not taken any steps to have notice issued. Therefore, the notice stands discharged. The Execution Application stands dismissed. (K.R. SHRIRAM, J.)
