This application is under clause XII of the Letters Patent to file Commercial Summary Suit against the defendant in this court.

Considering the submissions made by the learned counsel for the plaintiff and the averments made in the plaint particularly paragraph 17 of the plaint, I am satisfied that the plaintiff has made out a case for allowing this Leave Petition. Hence. same is allowed in terms of prayer clause (a) which reads thus:

"(a) that this Hon'ble Court may be pleased to grant leave to the Petitioner under Clause XII Mohite 1/2

901 lpetn251-17 of the Letters Patent of this Hon'ble Court for filing the above suit against the respondents abovenamed as aforesaid."
