By a separate order passed today in Company Application No.566 of 2014, the ex-parte winding up order dated 5 August 2014 against the Applicant herein ( the Respondent to the original Company Petition No.192 of 2012) was set aside. For the same reasons, the ex-parte order passed on 5 August 2014 in this matter following the main order passed in Company Petition No.192 of 2012 is also set aside and Company Petition No.119 of 2011 is restored on board. Learned Counsel for the Applicant submits that his client shall settle the claim of the original Petitioner on or before 19 October 2015. Place the original Company Petition, namely, Company Petition No. 119 of 2011, for settlement on 19 October 2015. The Company Application is disposed of accordingly. ( S.C.GUPTE J. ) Pg 1 of 2
