This Petition is under Clause XII of the Letters Patent. The proposed Suit is for repayment of loan facility which had been granted by the Petitioner to the Respondent.

The Petitioner's registered office is at Mumbai. The loan is to be repaid in Mumbai. It is only the Respondent's office which is situated outside Mumbai.

I am satisfied that the material part of cause of action having arisen within the jurisdiction of this Court, with leave granted under Clause XII of the Letters Patent, this Court will have jurisdiction to entertain and try the Suit.
