Present P.I.L. seeks writ of quo-warranto with regard to the appointment of respondent No.5, who was occupying the office of Vice Chancellor. The respondent No.5, by now, has not only completed his tenure as Vice Chancellor but even subsequent Vice Chancellor has ceased to be in the office. In that view of the matter, the question which is for consideration is only academic in nature. 2] The Apex Court has time and again observed that while exercising jurisdiction under Article 226 of the Constitution of India, this Court should not entertain the issue which remains only academic in nature. In that view of the matter, we are inclined to dispose of this PIL without adjudicating the claim. (B.P.COLABAWALLA, J) (B.R.GAVAI, J.)
