Today's meeting is fixed for the private examination of the Insolvent touching his estate and affairs.
In the meeting held on 3rd March, 2016 Registry was directed to send reminder letter to the Regional Passport Office and also to the Chief Commissioner of Income Tax about residential address of the Insolvent. Registry had written letters to the Regional Passport Office and also to the Chief Commissioner of Income tax but no reply is received from them. It appears from the record that the HDFC Bank, Lokhandwala Branch had sent statement of account of the bank account of Insolvent for the period 1st April, 2012 to 14th January, 2016 and in the said Statement of

Accounts, the address of the Insolvent is 402-C Wing, Oberoi Spring, Oshiwara Link Road, Opp Citi Mall, Andheri (W), Mumbai 400 053. The representative of the Official Assignee had also made an attempt to visit the residential premises of the Insolvent on 5th December, 2015. It was reported by the Representative of the Official Assignee that he could not take formal possession of the flat. It was further reported that the Manager of the society did not give any information about the said flat. The intimation of today's meeting was sent to the Insolvent at the last known address at Flat No. C-402, Oberoi Spring, Opposite City Mall, Off. New Link Road, Andheri (W), Mumbai 400 053 but the said letter could not be delivered to the Insolvent and the Office peon had reported that the Insolvent is not residing there. Shri Lahiri, Ld. Advocate appearing on behalf of the Petitioning Creditor states that they are trying to their efforts to find out the present residential address of the Insolvent as well as properties belonging to the Insolvent.

Registry is directed to send reminder to the Regional Passport Office and also to the Chief Commissioner Income tax requesting them to furnish the details of the present residential address of the Insolvent to the Official Assignee.

Registry is also directed to write letter to the Secretary and Chairman of the Society to furnish the details of the owners of the Flat No. C-402, Oberoi Spring, Opposite City Mall, Off. New Link Road, Andheri (W), Mumbai 400 053 and also to furnish the copies of the documents pertained to that flat.
Registry is also directed to write letter to HDFC Bank in respect of the account No. 01591000113933 standing in the name of Insolvent with a request to furnish the statement of account from 15th January, 2016 upto date and present status of the said account. They may be asked to furnish the present residential address and contact number of the Insolvent as per the books record.
Registry is also directed to write a letter to the Cyber cell of Mumbai Police to furnish details of IP address etc. whereby the Insolvent access his Email Id. navinjha792@ymail.com.
Registry is hereby directed to issue Rule Nisi against the Insolvent.
In view of the above, today's meeting stands adjourned to 13th January, 2017 at 12.00 noon.
