Shri Devani for petitioner states that respondent has deposited the sum of Rs. 22,44,185/- as directed in paragraph 7(i) of the order dated 7th September 2017.

In the circumstances, the petition suit, as per the self operative paragraph 7(ii), stands dismissed.

Shri Devani is seeking eight weeks time to file a suit. The amount has been deposited on 4th October 2017 and more than two months have passed since then. Petitioner had enough time to file the suit.
