Having heard learned Counsel appearing for the respective parties, we find that the impugned order is appealable under section 14 of the Maharashtra Motor Vehicles Tax Act, 1958. Since the Petitioner has an alternate and efficacious remedy, we are not inclined to entertain this writ petition in exercise of our jurisdiction under Article 226 of the Constitution of India and the same is accordingly dismissed. However, the Petitioner is at liberty to approach the appellate authority.

It is made clear that we have not gone into merits of the matter and all points and contentions of the respective parties are kept open.

In the event there is delay in preferring appeal, the Petitioner is always at liberty to take benefit of section 14 of the Limitation Act.
