These arbitration petitions, filed under Section 9 of the Arbitration and Conciliation Act, 1996 ("Act"), seek interim protection pending an arbitration reference in respect of a property, which forms part of a larger plot of land within a township project known as Arrow City Manhattan situated in the area of Taluka-Pen, District-Raigad, State of Maharashtra. Various arbitration petitions have been filed under Section 9 of the Act

In a group of matters, by an order dated 1 January 2016, a learned Single Judge of this Court has recorded and accepted the Respondent's undertaking not to create any third party interest in the subject property and not to part with possession of the same. Similar reliefs are sought in the present matters. These seven petitions concern seven different plots/units in the project, which are similarly situated as the group of matters referred to above. In the premises, the arbitration petitions are allowed in terms of prayer clause - (a) thereof.
Any further relief, including relief in the nature of what has been claimed in prayer clause (b), may be applied for before the arbitral forum under Section 17 of the Act.
The arbitration petitions are disposed in terms of this order and liberty.
