Petitioner is a registered partnership firm. Petitioner has filed this petition for a direction to the Respondent No.1 to examine the complaints made by the Petitioner through its Advocate in two letters both dated 20th July, 2018. These letters are addressed to the Income Tax Authority making certain allegations against one Safir Suleman Saiyad and Uday Tukra Salian. According to the letters, said Safir Suleman Saiyad and Uday Tukra Salian claim to have paid cash amount and valuables
Priya Soparkar 29 wp 2591-18-o to the Petitioner for purchase of immovable property. The Petitioner desires that this issue may be examined by the Income Tax Authorities. Learned counsel for the Petitioner submitted that if these persons as they have claimed paid cash or given valuable immovable properties to the Petitioner for the purchase of the flat, question of unpaid tax on such amounts would arise, which the Income Tax Authorities should examine. 2.
We are not inclined to entertain this petition. The Petitioner has already filed criminal complaint against the said persons. Whether the Income Tax Department should take cognizance of the allegations of the Petitioner is entirely the look out and consideration of the Revenue Authorities. Without any further basis, on general allegations of the Petitioner, we would not trigger an inquiry at the hands of the Revenue Authorities. 3.
Petition is dismissed.
