Mr. Pratap appearing for defendants state that suit has been dismissed by order dated 28th January, 2021 passed by the Appeal Court. Mr.Shanker states that he had entered appearance for plaintiff in the appeal but in his absence some other advocate has appeared and order came to be passed and he is not aware about the same.

Mr. Pratap says that Appeal Court accepted the appearance of new advocate and has passed the order of dismissal of the suit. Mr. Pratap says that authorised signatory of plaintiff was also present in the court. 3.

I have sighted copy of the order dated 28th January, 2021. Suit be noted to have been dismissed.

All interim applications stand dismissed.
