This petition was directed to be heard along with Writ Petition No.2613 of 2008. Writ Petition No.2613 of 2008 is between the employer and the Union and the present petition concerns an individual employee. Learned counsel for the parties state that, since the Writ Petition No.2613 of 2008 is disposed of by way of consent terms incorporating the memorandum of understanding dated 12 December 2015, the said memorandum of understanding will cover the case of Respondent No.1 in the present petition as well. Learned counsel for the parties agree that the impugned order passed by the Industrial Court, Mumbai, dated 21 February 2015 shall stand substituted in terms of the consent terms filed in Writ Petition No.2613 of 2008. The parties shall place a copy of the consent terms in the file of the Writ Petition

The writ petition is disposed of in the above terms. 3.

In view of the understanding reached between the parties, criminal complaint does not survive. Liberty to the parties to place copy of this order before the Court hearing the criminal complaint, for suitable orders for disposal.
