The petitioner sought an urgent protection against dispossession and after hearing both sides on 1-9-2016, we passed, and what is, in our opinion, an equitable, fair and just order. Since the premises occupied by the petitioner were residential, we went out of our way to protect his claim and equally balanced all rights and equities.

It is stated now, on instructions, by the petitioner's Advocate that the petitioner could not comply with the order passed on 1-9-2016.

We do not think that we can indulge the petitioner any further. Since the order is not complied with, we cannot assist the petitioner in writ jurisdiction. The writ petition is dismissed. The ad-interim order is vacated forthwith. (B.P. COLABAWALLA, J.) (S.C. DHARMADHIKARI, J.)
