The counsel for applicant states that the sole proprietor of applicant had to be admitted to hospital for bypass surgery and hence the amount of Rs.10,000/- as per direction in paragraph 7(ii) of the order dated 28th June, 2017 could not be complied with. The counsel for applicant further states that during the course of today this amount of Rs.10,000/- will be paid to the Prothonotary and Senior Master, High Court, Bombay.
In view of this statement, which is accepted as an undertaking to this Court, the petition is restored to file. Application accordingly stands disposed.
The counsel for applicant states that the amount of Rs.39,80,282/- which this Court had directed respondent to deposit has not Gauri Gaekwad
