It is informed that the mandate of the arbitral tribunal expired on 1 June, 2020 and the orders passed by the Supreme Court in the proceedings of Suo Motu Writ Petition (Civil) No. (s) 3/2020 in the case of Re: Cognizance for Extension of Limitation1 and also followed by this Court in ICATCH Communications India Ltd. vs. The Divisional Manager/Authorized Personnel & Anr. in Arbitration Petition (L) No. 381 of 2020 would become applicable in the present proceeding, which is filed for extension of mandate of the arbitral tribunal. It is submitted by learned counsel for the parties that recording of oral evidence of the respective witnesses is in progress. It is also informed that the parties are making an endeavour to settle the disputes. In this circumstances, prayer is made for extension of the mandate of arbitral tribunal till 31 December, 2022. 3.
It needs to be noted that this is for the third time that the extension of mandate of the arbitral tribunal is sought. In the above circumstances, the mandate of the arbitral tribunal is extended finally upto 31 December, 2022, by which the award can be published by the arbitral tribunal if the settlement is not brought about. Ordered accordingly.
