Mr.Sawant appearing for plaintiff/applicant states plaintiff/applicant has come across certain documents and there are further developments in the matter which required amendment to the plaint and consequently amending the notice of motion. Mr.Sawant states that plaintiff be given liberty to take out a fresh notice of motion, if advised, after hearing and final disposal of plaintiff's application for leave to amend the plaint which is proposed to be taken.

Mr.Sawant also requests that the observation of this Court in its order dated 11th October 2013 of steps to be taken by defendants would be subject to the further orders to be passed by this Court be continued. Shraddha Talekar PS 1/2

19.nms.369.13.s.2577.2012.doc Mr.Singh for defendant nos.1 to 3 and Mr.Kadam for defendant no.4 have no objection if the notice of motion be disposed with the liberty as prayed for and the observations as quoted above being continued. In the circumstances, keeping open all points and without prejudice to the rights and contentions of parties including liberty to raise all contentions in the present notice of motion, the notice of motion stands disposed with liberty as sought.
