Learned counsel appearing for the petitioner on instructions seeks liberty to withdraw this petition with liberty to apply before the learned arbitrator for recalling of the order passed by the learned arbitrator.

The arbitration petition is dismissed as withdrawn with liberty as prayed. It is however, made clear that this Court has not expressed any views whether any such order passed by the learned arbitrator can be recalled or not and if any such application is made, the learned arbitrator may decide the same on its own merits. No order as to costs.
