After having heard both the sides, we do not find any need for interference under Article 226 of the Constitution of India by this Court and at this stage. More so, when an inquiry under section 7-A of the Employees Provident Funds and Miscellaneous Provisions Act 1952 is underway. That inquiry is pending for more than one year now. It is time for the Authority to conclude the said inquiry.

The Authority expects this Court to issue a direction to the Petitioner to cooperate in early disposal of the inquiry. We do not think that the Authority is helpless if the Petitioners are prolonging the proceedings. In any event, we do not find any such material before us. In such circumstances, we would expect the Authority to conclude the inquiry as expeditiously as possible and in any case within three months from today. We keep open all contentions including based on the grounds in this Writ Petition for being raised at an appropriate stage and before appropriate forum. The Writ Petition is disposed off. No costs.
