IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION NOTICE OF MOTION NO.1652 OF 2015 IN SUIT NO.828 OF 2015 Rajpurohit Communications Private Limited ... Applicant In the matter between Rajpurohit Communications Private Limited ... Plaintiff

Versus

Shree International ... Defendant Mr. Ajit Anekar, with Mr.

Thomas J. i/b Auris Legal for the Plaintiff.

CORAM: G.S. PATEL, J DATED:

25th July 2016 PC:- 1.

After some arguments, Mr. Anekar seeks to withdraw the Notice of Motion. He further submits that all contentions ought to be left upon to the final hearing of the Suit. This is correct, and it is so ordered. He also states that the Defendants have commercially exploited the film and under the agreement between parties there is a revenue sharing provision.

2.

In my view, it is sufficient if the Defendants are directed to maintain accounts in respect of the exercise of their rights under the 25th July 2016

231-NMS-1652-2015.DOC Film Assignment Agreement dated 5th May 2012, Exhibit "A" to the Plaint.

3.

Subject to this, the Notice of Motion is disposed of as withdrawn with no order as to costs, expressing keeping open all contentions.
