Mr. Inamdar, counsel for petitioner states that Insolvency Resolution Professional has already filed an application under Section 31 of the Insolvency and Bankruptcy Code praying for allowing the resolution plan prepared with concurrence of the Committee of Creditors. Mr. Inamdar further states that the application was listed today but did not get called out due to paucity of time and the next date is 17th July 2018. If the resolution plan is accepted, then nothing will remain in this petition and if it is rejected, the company will be ordered to be liquidated.

Therefore, petition dismissed with liberty to petitioner to approach National Company Law Tribunal and/or Insolvency Resolution Professional, who shall consider petitioner's claim in accordance with law. All rights and contentions of petitioner are kept open. (K.R. SHRIRAM, J.) Gauri Gaekwad
