This petition challenges an order passed by Deputy Registrar of Co-operative Societies on 8 March 2017. By the impugned order, the Deputy Registrar issued a notice under Section 83 of the Act initiating an enquiry into the working of the Petitioners, who are office bearers and managing committee members of Respondent No.3 Society. In pursuance of the impugned order, the Assistant Registrar of Co-operative Societies has made an enquiry and prepared a report. Deputy Registrar of Co-operative Societies has indicated his disagreement with some of the points made in the report. By his letter dated 12 January 2018, which is produced by Respondent No.3 before the Court, the Deputy Registrar has indicated that there will be a re-audit of the society and, thereafter, if Pg 1 of 2
wp400-18.doc necessary, action would be initiated under Section 88 of the Maharashtra Co-operative Societies Act. In view of these developments, the petition is rendered infructuous and is disposed of as such reserving liberty unto the Petitioners and the contesting Respondents to agitate their grievance in the course of the re-audit and action, if any, under Section 88 of the Act in pursuance thereof.
