The chamber summons is taken out by a legal heir and next of kin of the deceased whose last will and testament is the subject matter of the present testamentary suit. The Applicant has filed a caveat. There is, however, a delay of four days in filing his affidavit in support of the caveat. By this chamber summons, condonation of that delay is applied for. For the reasons stated in the affidavit in support of the chamber summons, the delay is condoned. Office shall take the affidavit of the Applicant in support of the caveat on record.
