After arguing for some time, the learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to the Petitioner to seek relief sought in the Petition before the Civil Court by filing a Civil Suit.

With the aforesaid liberty, the Petition is allowed to be withdrawn.

All contentions of both the sides are kept open. 5.
Needless to say that we have not commented upon the merits of the matter.
