This petition is filed under section 58(3) of the Juvenile Justice (Care & Protection of Children) Act,2015. Asha Sadan Balgruh and Copetitioners-Deepak Yadavrao Gunjal and Ashvini D, Gunjal have filed this petition seeking appointment of the co-petitioners as adoptive parents of minor male child named Mayur born on 26th February, 2021 who is in the care and protection of M.S.W.C. Umerkhadi, Mumbai and for consequential reliefs of change of name, leave to remove the child from the jurisdiction of this court to reside with the prospective adoptive parents. The biological mother of the child has executed a deed of surrender before the Welfare Committee on 8th March, 2021. Safe Custody order is on record. 2.

After making due inquires under the Juvenile Justice (Care & Protection of Children) Act, 2015 the minor was declared free for adoption on 12th May, 2021 as seen from Exhibit B-1. The prospective adoptive parents are motivated to adopt the child who was initially seen by them online and subsequently been in foster care with them for some time.

The medical health report certifies good health of the prospective adoptive parents and the child. The prospective adoptive father works as Senior Assistant with a private company. The mother is also engaged as Medical Coder. Both are said to be earning sufficiently to enable them to bring up the child in reasonable comfort and provide a secure future of the child. Medical reports of the child are on record. The declaration and willingness of the prospective adoptive parents has been recorded.

The prospective adoptive parents also have a biological child named Sejal who is 12 years old. Her birth certificate has been placed 2/3

on record today along with her medical reports all of which seem to be in order. The prospective adoptive parents are present today along with their daughter Sejal and the minor who is in foster care and have confirmed their desire to proceed with adoption. 5.

Having heard Ms. Bhogle in support and having perused the record, I have no hesitation in allowing this application. Accordingly I pass the following order :

(i) Petition is made absolute in terms of prayer clause (a) to (e) both inclusive.

(ii) Prospective adoptive parents shall invest a sum of Rs. 3,00,000/- in the name of the child in LIC's Single Endowment Plan No.917. No loan shall be taken on the policy. The petitioner shall file evidence of this fact having been communicated to the LIC in the registry.

(iii) Undertakings are accepted.

(iv) Accordingly, Judges order is signed separately. (v) Petition is disposed in terms of the above.
