By this Notice of motion the plaintiff seeks restoration of contempt petition no. 28 of 2010. It is stated that Chamber Summons(L) No. 420 of 2016 has already been allowed. In the circumstances, learned counsel for the petitioner submits that the notice of motion may be allowed so that contempt petition may be taken up for hearing.

Having heard learned counsel for the parties and considering the reasons given in the affidavit in support of the Chamber summons, I am of the view that the Chamber Summons deserves to be allowed. Accordingly, I pass the following order : (i) Notice of Motion is made absolute in terms of prayer clause (a). (ii) Contempt petition no. 28 of 2010 is restored to filed and to be listed on th October, 2018.
