Though the suit No.2536 of 2009 is called out twice, once in the prelunch session and once in the post-lunch session, nobody appeared for the plaintiff.

The suit, therefore, stands dismissed for want of prosecution. The counsel for the defendant-plaintiff in the counter-claim states that the defendant has not filed any written statement to the counter-claim though it was served in June 2011. The counsel undertakes to file affidavit of service within one week from today.
