Following the order dated 25th July, 2017 M/s. H. Mehta & Associates was appointed as Valuer for valuation of the suit property. By letter dated 6th September, 2017, the valuer has requested plaintiff's Advocate to get the time extended for submitting the report. Valuer also has fixed the date for inspection of the suit property as 16th September, 2017.

Therefore, time for the Valuer to inspect the property and submit the report is extended upto and including 7th October, 2017. Valuer to provide copy of the report to plaintiff's Advocate and to advocate for defendant Nos.1, 2, 6 & 7.

Mr. Jain, counsel appearing for defendant No.1 & 2 reiterates the statement made by defendant No.1 & 2 on 14th September, 2011 that SKNair

2/2 20-nms-2705-11-s-1182-11.doc defendant No.1 and 2 will not dispose of, alienate, encumber, part with possession or create any third party rights in respect of the suit flat. Mr. Jain states that this statement will be effective until hearing and final disposal of the suit.

In view of the statement made, both the counsel state that notice of motion can be considered as disposed. Notice of motion accordingly stands disposed. The suit be listed on 13th October, 2017 for directions. (K.R. SHRIRAM, J.) SKNair
