Prayer for quashing and setting aside the Town Planning Scheme No.IV which was sanctioned in the year 1963 and prayer for amending the said Scheme cannot be considered in this Petition under Article 226 of the Constitution of India filed on 29th July 2015. Faced with this difficulty, the learned counsel appearing for the Petitioner seeks permission to withdraw this Petition with liberty to file a fresh Petition seeking other appropriate reliefs. Accordingly, we dispose of the Petition as withdrawn with liberty as prayed.
