Learned counsel for the parties have tendered consent terms dated 30 April 2015 signed by the authorized signatory of the appellant as well as authorized signatory of the respondent and the respective Advocates for the parties. The authorized representatives of the appellant and respondent having signed the consent terms have stated that the appellant has paid the respondent Apex Pharma, a sole proprietory concern of Mr.Kirit Doshi, Rs.15 lakhs by pay order dated 28

2 of 2 APP.456.2014 April 2015. The aforesaid amount is paid in full and final settlement of the claims that parties had with each other. 2.

The consent terms are taken on record and marked "X" for identification. The undertakings contained in paragraphs 3 and 5 are accepted.

The appeal stands disposed of in terms of the consent terms.

It is clarified that the amounts deposited with the learned Arbitrator Mr.Firdosh Pooniwala shall also be paid in accordance with Clause-4 of the consent terms. (CHIEF JUSTICE) (G.S.KULKARNI, J.) MST
