Heard learned Counsel for the parties. The matter is mentioned for extension of time to comply with the condition of deposit passed on the summons for judgment. In the first matter, i.e. Summons for Judgement No.69 of 2016, the Defendant was put to the condition of deposit a sum of Rs.64,68,830/- within six weeks. Learned Counsel for the Defendant states

Chittewan 2/2 P-1..doc that time expires tomorrow and about Rs.33,00,000/- that is to say, a little over 50 per cent of the amount is being deposited in the court during the course of the day. Learned Counsel states that his demand draft is ready and will be tendered in the Registry. Learned Counsel, in the premises, seeks extension of time for depositing the balance amount. Time is extended by a further period of four weeks.

As far as Summons for Judgment No.70 of 2016 is concerned, learned Counsel for the Defendant seeks extension of time. Even here time expires tomorrow. Time is extended by further period of four weeks. No further extension would be granted in either of the two cases. (S.C. GUPTE, J.)
