The Appellant, appearing in person, is absent. Shri Talsania, learned Senior Counsel appearing on behalf of Respondent No.1 submits that the Appellant wants to engage an advocate. We are of the view that practically the appeal has become infructuous.

The Appellant was terminated by Respondent No.1 -Air India Ltd. and against that order, they have sought approval under provisions of section 33 (2) (b) of the Industrial Disputes Act. The Industrial Court did not grant approval. However, the learned Single Judge has allowed the writ petition filed by Respondent No.1. It is 1 / 2
APP 708 of 2004 an admitted position that the Appellant did not file any Reference under section 10 of the Industrial Disputes Act. Hence, the appeal has become infructuous. We are not inclined to entertain this appeal. Appeal is dismissed for want of prosecution.
